		<description>I am a photographer. Using the photo and then planning to offer to pay the photographer if he ever sees it is a bit like walking out of a Home Depot with a chain saw because you couldn't find anyone to help you check out and then offering to pay for it when they chase you down in the parking lot. If a photo has been in the public domain for decades, fine. Use it. But don't use that line of thinking for any photo! It sets a dangerous precedent! Thank you for giving respect to hard working photographers who don't get paid much for what they produce. And, remember, the Copyright Law of 1976 is the law. Every photographer owns the copyright to the photo the instant it is created.</description>

		<description>I say just go ahead and use it, its an old picture and has been around in the public domain now for a long time.  If the photographer ever does see the picture on your website, which is extremely unlikely, you can then ask him about buying it, because you didn't know who to buy it from in the first place.  How does that sound to you?</description>
